Divorce & Post-Divorce
To get divorced, you and your spouse must agree to a resolution of all issues in your case or, if an agreement is not reached, a trial must be held so a judge can determine those issues. What are those issues?
In all divorce cases, assets and debts must be equitably, or fairly, distributed between you and your spouse. Assets include real estate, businesses, cars, bank accounts, household property and retirements. Debts include mortgages, home equity loans, car loans, credit card accounts, loans and tax debt. If spousal support is needed, the amount and duration of that support must be determined.
If you have children, a Permanent Parenting Plan must be determined setting out custody, visitation, decision-making and financial support arrangements for the children.
Uncontested Divorce
If you and your spouse amicably resolve all issues and sign the documents required by the Judge to enter a judgment divorcing you, you have an uncontested or agreed divorce. An uncontested or agreed divorce results in a quick, cost-effective divorce. Our attorneys will identify all the issues which need to be addressed in your case, and advise you about possible resolutions. Once agreement is reached by you and your spouse, our attorneys will draft the required documents to present to the Judge to finalize the divorce.
Contested Divorce
If you and your spouse cannot agree on the issues in your case, you have a contested divorce. Contested divorces are resolved by a Judge after a trial. Our attorneys will use their years of courtroom experience to guide you through the contested divorce process. Your attorney will conduct different forms of discovery, speak with potential witnesses, prepare experts, prepare you and your case for trial and present your case to the Judge. Settlement negotiations will most likely occur while trial preparation is ongoing, and you will attend mediation before trial if settlement is not reached.
